These Terms of Use apply to the website www.SaveFoodCutWaste.com (“SFCW”) owned by Zero Waste SG (“ZWS”). These Terms of Use also apply to the various services, including all information, communications, links, software, electronic newsletters, services, advertisements, other materials and any and all other services that may be added, offered or provided to you from time to time (the “Services”) through SFCW. Please read this statement carefully before proceeding to access SFCW. Your use of SFCW indicates your agreement to abide by the Terms of Use in effect.

These Terms of Use may be revised or updated from time to time. Your continued use of SFCW shall be deemed and construed as your conclusive and binding acceptance of the revision or updated terms.

Intellectual Property Rights

The copyright in SFCW is owned by ZWS. This excludes material which are stated by ZWS that the copyright belongs to a third party. No part or parts hereof may be reproduced, distributed, republished, displayed, broadcast, hyperlinked or transmitted in any manner or by any means or stored in an information retrieval system without the prior written consent of ZWS. You also may not, without ZWS’s written permission, insert a hyperlink to SFCW on any other website or ‘mirror’ any material contained on SFCW on any other server.

All trademarks, service marks, logos and any other marks whatsoever are used for the benefit of their respective owners and are not intended to infringe the trademark of any such person.

Submission of Contributions

ZWS may provide facilities on SFCW to permit you to submit any contribution (including but not limited to any recipes, text, comments, photos, graphics, video and/or audio content, and other materials or information) (“Submissions”) to ZWS or to SFCW directly. You are solely responsible for your own Submissions, and SFCW only acts as a passive conduit for the online distribution and publication of your Submissions.

By submitting your Submissions, you agree as follows:

(a) You will not include any content in your Submissions that is or could be unlawful, defamatory, offensive, obscene, dangerous or false, or any content that is protected by copyright or other intellectual property right, without first obtaining permission of the copyright owner or rights-holder, or any content that contains any viruses, bugs or other harmful elements;

(b) You hereby grant to ZWS unlimited rights to use, distribute, reproduce, and disclose your Submissions as ZWS deems appropriate, without compensation or acknowledgement of its source. This does not apply to material which are stated by ZWS that the copyright belongs to a third party;

(c) You will not assume a false identity or the identity of another user when using SFCW, and you will not use SFCW for any unlawful or illegal activities, including but not limited to spamming, harassing or otherwise causing distress to other users.

ZWS shall have the right to remove or delete any Submissions contributed to SFCW that ZWS, in its sole discretion, finds to be in violation of these terms or otherwise objectionable or inappropriate without having to assign any reason therefore.

If you submit or provide any personally identifiable information through SFCW, you acknowledge and consent to ZWS collecting and using such information for various purposes, including without limitation, verification and record of your personal particulars, comparing it with information from other sources, to communicate with you and/or to send you information and promotional material about SFCW or third party organisations selected by SFCW.

ZWS does not guarantee, approve or endorse the information, products and/or services available at these third party websites, nor does a link indicate any association with or endorsement by ZWS. Our inclusion of advertisements and directory listings for a third-party site or service does not constitute an endorsement.

ZWS does not operate or control and has no responsibility for the information, products and/or services found on any external sites. It is up to you to assume complete responsibility and risk in your use of any external sites.

Disclaimer

All Services in SFCW are provided on an “as is” and “as available” basis. ZWS makes no warranty as to the accuracy, adequacy or completeness of such Services and expressly disclaims liability for errors or omissions in such Services.

The Services by SFCW may be modified, deleted or replaced from time to time and at any time in the absolute discretion of ZWS.

Exclusion of Liability

ZWS shall in no event be liable for any damages, loss or expense including, without limitation, direct, indirect, special or consequential damage or economic loss arising from or in connection with:

(a) Any access, use or the inability to access or use SFCW, or reliance on the contents of SFCW;

(b) Any system, server or connection failure, error, omission, interruption, delay in transmission or computer virus;

(c) Any use of or access to any other website linked to SFCW;

(d) Any services, products, information, data, software or other material obtained from SFCW or from any other website linked to SFCW.

Governing Laws

These Terms of Use shall be governed by Singapore laws and any dispute arising out of the use of SFCW shall be referred to the Singapore courts.
